These rules are in effect for each participating production team.
48musicProject.com Organizers may add to or amend these rules at any time.

48 Music Organizers may add to or amend these rules at any time prior to or after the Registration of the Entrants or prior to or after the beginning of the 48 hours' competition time period.

OFFICIAL RULES:

1. ELIGIBILITY:

You must be 18 years old or older to be a Team Leader. If you are less than 18 years old, you may participate on a team as an Entrant, but your parents or guardian must sign the Waiver and Release document and give it to your team leader. Team Leaders and Entrants ("Entrants") must agree to the terms of 48MUSIC Team Leader's Agreement.

The following are not eligible: employees, contractors, directors and officers of Creamy White Inc. and The 48Projects Inc. ("48M"), its parent, subsidiaries and affiliated companies, distributors, web design, advertising, fulfilment, judging and Project agencies involved in the administration, development, fulfilment, and execution of this Project (collectively, "Project Parties"), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Project). Outside of the United States, residency requirements may vary. Void where prohibited.

2. THE COMPETITION:

The 48MUSIC is an online music competition. Teams receive their assignment via the web, they upload their completed song via the web, and their song is streamed on the web. The public has a chance to vote for a People’s Choice Winner, and there is a separate judging for the top 15 Songs of the Year, including the Grand Prize.

3. TO ENTER:

To register for the Ultimate International Music Competition, 48MUSIC, follow the instructions found on 48music.com. Registration is based on a first-come, first-served basis. Standard registration to enter the competition is $50. Special promotions or exclusions to this price may apply at 48M’s discretion. Entrants will be prompted to provide payment information as well as agree to the terms and conditions before they can proceed with the competition. The submission cost is not transferable and is not refundable.

4. COMPETITION PERIOD:

48Music.com will commence on January 2, and proceed until 30th of November each year. Registration begins the team’s sign-up for the competition, and pushing the "Start my Competition" button begins the individual competition period, which lasts 48 hours from the time of acceptance of the terms. Eligible Entries will be judged based on the judging criteria stated below.

5. PROJECT TERMS OF SUBMISSION:

By submitting an Entry into this Project, each Entrant warrants and represents that the Entrant owns all rights to the Entry he/she is entering in this 48MUSIC, including, without limitation, the audio or digital recording, and the performance contained in each Entry, with the exception of any assets provided by 48MUSIC for use by Entrants in connection with this Project. Each Entrant further warrants and represents that the Entrant has obtained permission from each person who appears in the Entry to grant the rights to the Project Parties described in these Official Rules, and will submit copies of such permissions to the Project Parties. By submitting an Entry, Entrant agrees to the Official Rules, and further agrees to indemnify and hold the 48M, Project Parties and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Project Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Project Indemnities due to or arising out of the Entrant's Entry materials in this Project, or the Entrant's conduct during and in connection with this Project, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. Entrant agrees to release, indemnify and hold harmless 48M and the Project Parties from any and all claims that any advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of 48M or the Project Parties infringes on the rights of Entrant's work as contained in any Entry.

6. TEAM LEADERS:

As a condition of entry, participants must agree to the Team Leader's Agreement, which sets forth the rights of Entrant and 48M with respect to the use of Entries by 48M. Entries that do not include all required information and adhere to the foregoing and following requirements will be considered void and will not be considered in this Project.

If any group of individuals elects to collaborate on an Entry, they are required to designate one (1) person as the agent of the group to enter the Project, agree to these Official Rules, sign the Team Leader's Agreement and accept the prize on behalf of the group. Neither 48M nor any of the Project Parties are liable for any disputes between collaborators arising out of or related to the Project.

7.SELECTION OF WINNERS:

Entries will be judged as follows:

After all entries are processed, the public will vote online for their three favorite songs from all entries from that year. This voting period will last from December 1, to December 30 each year. The top results of this vote will be tabulated, and the winner of all of these votes will be declared the People’s Choice Award Winner. The TOP 15 winners will be selected by top industry professionals and are in with a chance to be chosen as the Grand Prize Winner who will perform their song on a world-famous stage in Hollywood.

8. GENERAL CONDITIONS:

By participating, Entrants agree to these Official Rules, which are final and binding in all respects. The Project is governed by the laws of Beverly Hills, California, USA, and all claims must be resolved in the United States.

9. LIMITATIONS OF LIABILITY AND RELEASE:

No liability or responsibility is assumed by 48M or Project Parties resulting from any user's participation in or attempt to participate in the Project or ability or inability to upload or download any information in connection with participating in the Project. No responsibility or liability is assumed by the 48M or Project Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Project: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Project, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Project, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Project. 48M and Project Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. 48M and the Project Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Project, use of the Web Site or the download of any information from the Web Site. By participating in the Project, Entrant agrees to release, indemnify and hold 48M and Project Parties harmless from any and all claims, damages or liabilities arising from or relating to such Entrant's participation in the Project.

12. TIMES:

48Music.com will occur all around the world each year. Annual competition is starting every January 2, of each year and is going through November 30th unless otherwise specified into this terms and conditions. Each individual team project begins with their registration, including payment and acceptance of official terms and rules. The competition period is the "Official Project Time Period.” Each team must create a complete song, and uploaded to the 48music.com within 48 hours of starting time. Following that, there will be a two hour period bonus for submitting song and appropriate production documents to the website. Only works that meet the deadline will be officially part of the competition. All Competition entries received in accordance with these guidelines will be streamed on the official website www.48music.com

13. CREATIVE WORK:

All creativity must take place during the team’s Official Project Time Period. Any creative work in advance of the competition weekend is prohibited. Creative work includes, but is not limited to:

  1. Producing
  2. Song writing
  3. Rehearsing
  4. Musical score
  5. Recording
  6. Editing
  7. Sound Design
  8. Cover Art design

The only work that may take place prior to the Official Project Time Period is:

  • Organizing Songwriters
  • Organizing Musicians
  • Securing Equipment
  • Scouting/Securing recording studio

All tracks must be recorded within the 48 hours' time period of the project. No stock tracks or pre-recorded tracks that may be used.

14. ASSIGNMENTS:

Each participating Competition Team Leader is responsible for checking his/her Account Page immediately upon pushing the button "start my Competition" to receive the assignments. The assignment will include a Song Theme for its music–assigned randomly; in addition there will be a Golden Key, (a word or phrase) that must be included in the song lyrics.

The Song (or Music) Theme is just that - a theme. It can be in any musical style preferred by the Entrant.

The Golden Key is a word or a phrase and must be included in the Entrant's composition exactly as it is given. The required Golden Key must be used verbatim within the official time limit of the song length as specified in Note 16. It may be spoken, and/or sung. Any composition submitted without the assigned Golden Key will be disqualified.

15. LANGUAGE:

The song must be in English ONLY!

16. LENGTH:

The finished song must be a minimum of two (2) minutes in duration, and a maximum of four (4) minutes in duration.

17. CREDITS:

Credits should be given on the cover page. You need to include the following:

- title of your song
- your team’s name
- city or State/Country
- “This song was created for the 48music.com 2016”

The back cover of the CD should be labelled completely as a professional CD would and to be uploaded within the 48 hour competition time period or within the extra bonus 2 hours upload time.

18. SUBMISSION FORMATS:

For the competition, specific uploading instructions for uploading Team’s Entry will be posted on the website. The Audio must be in one of the following formats: .wav or .aiff, 16 bit PCM

Within the 48 hours competition period or within the extra given two hours after the Official Project Time Period, the team must have uploaded their song. All teams will have this additional 2 hours to upload their song. Each team may upload multiple versions of their audio file, and 48M will take the best quality version. The maximum file upload size allowed is 450 MB. Included should be uploaded a document for a CD cover including the complete artwork. This should have a title page with: team name, date, city or State/Country, title, and music theme, as well as the line "This song is made for the 48Music.com 2017"

19. PAPERWORK REQUIREMENTS:

Each team must secure releases for talent, musicians, crew and any other applicable releases.

48MUSIC Finalists, upon notification that they are finalist, will be expected to submit their releases and a Certification Statement, certifying adherence to all Official Rules. This paperwork is required to be eligible for the Grand Prize. The release forms will need to be sent at the 48PROJECTS Inc. via email: mngr@48projects.com

20. ELIGIBILITY:

To be eligible for the Project, Entries must be the original work of the Entrant; must not infringe third-party's rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements about any person, company, organization or entity; may not invade privacy or other rights of any person, company or entity; may not in any other way violate applicable laws and regulations; and may not contain any copyrighted elements (other than as owned by the Entrant and/or 48M). Entries containing prohibited or inappropriate content as determined by the 48M, in its sole discretion, to be inappropriate will be disqualified. 48M reserves the right to make the final determination as to which Entries are eligible.

To be certified as an "Official 48MUSIC Song", each participating group's music production must follow all rules herein. The 48MUSIC Organizers reserve the right to screen only certified "Official 48MUSIC Song."

48M and Project Parties may, in their sole discretion, disqualify Entries deemed to be inappropriate or otherwise non-compliant.

All certified "Official 48MUSIC Songs" are eligible to compete for the grand prize.

21. SONG OWNERSHIP:

All songs created for the 48Music.com as well the rights reserved for festival organizers and after the first 2 years of the competition songs belong completely to the original creators.
